Terms & Conditions
These terms apply to your use of this website and to the services AL Construction provides in Mississauga, Oakville and the surrounding area. When we quote or contract a specific job, the written estimate, quote or agreement for that job also applies; if it conflicts with these terms, the written agreement wins.
Nothing in these terms takes away rights you have as a consumer under Ontario's Consumer Protection Act or any other law that cannot be waived. Where these terms and that law differ, the law applies.
1. Using this website and your account
- The website is provided for information and to request our services. Content, photos and branding belong to us or our licensors and may not be copied for commercial use without permission.
- The customer portal is for our customers. You sign in with a one-time code emailed to you; keep that code private and tell us if you think someone else has used your account.
- You agree to give us accurate contact and property information and to keep it current.
- We may suspend access to the portal if it is misused or if an account is in serious arrears.
2. Estimates and quotes
- Renovation, flooring, painting, drywall and interlock work is estimated only after we have seen the property. Figures we discuss before a site visit are indicative.
- Landscaping and snow removal plans can be quoted from the property map you draw online. That quote is confirmed after our walk-through; if the property differs materially from what was drawn, we will adjust the price with you before work begins.
- Estimates and quotes are valid for 30 days unless they say otherwise.
- Under Ontario's Consumer Protection Act, when we give you an estimate the final price will not exceed it by more than 10% unless you agree to a change in the work. Changes in scope are confirmed in writing before we proceed.
3. Contracts and your right to cancel
- Work over $50 is covered by a written agreement that sets out the scope, price, schedule and payment terms.
- If the agreement is made at your home or anywhere other than our place of business, it is a direct agreement under Ontario's Consumer Protection Act and you may cancel it for any reason within 10 days of receiving your written copy, by notice to us.
- After the cooling-off period, cancellation terms are those in your agreement. Materials ordered specifically for your project and work already completed may be charged.
- We may cancel or pause work if the site is unsafe, if required permits or access are not available, or if payment is overdue, after giving you reasonable notice where possible.
4. Recurring landscaping plans
- Visits run on the schedule in your plan (typically two or three visits a month, weekly in spring and every two weeks in summer, or on request). We confirm the schedule after seeing the property.
- Monthly plans are billed monthly with a deposit and have a three-month minimum. After that you may cancel at any time; visits already completed in a billing period are charged.
- If weather prevents a visit we reschedule it within a few days rather than refund it.
- Add-ons such as spring and fall cleanups, aeration, mulch top-ups or gutter cleaning are quoted separately and added to your plan.
- After each visit we send an update with photos by text, email or WhatsApp, according to the preference you set.
5. Seasonal snow removal plans
- The season runs November 1 to March 31. Seasonal plans dispatch automatically once the snowfall trigger in your plan is reached; snowfall is confirmed by our crew on site, Environment Canada readings and our weather service. You may also request a visit.
- Each plan has a clear-by deadline measured from the end of the snowfall. During prolonged storms we clear in stages and return as the plan provides.
- The seasonal price is flat and covers the whole season regardless of how much snow falls. There is no refund in a light winter and no extra charge in a heavy one, except for add-ons you choose.
- You may pay in full, in two instalments or in three; the schedule is in your agreement. Instalments are due on the dates shown whether or not it has snowed.
- Salting and de-icing are optional add-ons. Between visits, ice, refreezing and drifting snow remain the property owner's responsibility.
- Before the season we walk the property with you, take photos, install snow stakes and mark gardens, edges and the agreed spot where snow is piled. We repair any damage caused by our equipment; we are not responsible for damage to items that were not visible or marked, or to pavement that was already cracked or loose.
- Cars, bins and other obstacles left in the driveway are worked around, not moved, and the area under them is not cleared.
6. Complete 365 bundle
The Complete 365 bundle combines one landscaping plan and one snow removal plan into a single monthly payment for the year. Each part is governed by the sections above for that service. Cancelling the bundle cancels both parts; the landscaping minimum term and the flat seasonal snow price still apply.
7. Scheduling, access and site conditions
- You will provide access to the work area at the agreed times, including gate codes or keys where needed, and keep pets and children clear of the site.
- You will tell us about known hazards, underground sprinklers or lighting, and anything you want protected. Instructions recorded in your property profile are followed by every crew.
- Hidden conditions discovered during work — for example uneven subfloors, moisture, mould, asbestos, knob-and-tube wiring, buried debris or poor soil — are outside the original estimate. We stop, explain the options and quote any extra work before continuing.
- Before excavation for interlock or landscaping we request utility locates through Ontario One Call as the law requires. Private lines (sprinklers, low-voltage lighting, septic) are not covered by locates; tell us where they are.
8. Permits and compliance
Work that requires a permit under the Ontario Building Code — structural, plumbing and electrical changes, some additions and basement finishes — is done only with the permit in place. Where your agreement includes permit handling we apply, coordinate inspections and pass on the municipal fees; otherwise you obtain the permit before work starts. Electrical work is performed by a licensed electrical contractor under the Electrical Safety Authority rules.
9. Payment
- Deposits, progress payments and final payments are due as set out in your agreement or invoice. Accepted payment methods are listed on the invoice.
- If an invoice is overdue we may pause further work until the account is current.
- Recurring plans are billed to the schedule you chose. If a payment fails we will let you know and retry; visits may be paused while the account is overdue.
- For construction work, Ontario's Construction Act gives us lien rights and, where it applies, requires the owner to retain a 10% holdback until the lien period has expired. Its prompt-payment rules apply to invoices issued under that Act.
10. Workmanship and warranties
- We perform our work in a good and workmanlike manner and in accordance with the Ontario Building Code and manufacturer instructions.
- Workmanship on renovation, flooring, painting, drywall and interlock projects is covered for the period stated in your agreement. Tell us in writing about a defect as soon as you notice it; we will inspect and repair or redo the affected work at no charge.
- Manufacturer warranties on materials and products are passed on to you and are handled under the manufacturer's terms.
- The warranty does not cover normal wear, settling of soil or base you supplied, damage from moisture or other conditions we told you about, changes made by others, or lack of maintenance. Plants and sod are living material and are not guaranteed against weather, pests or watering unless your agreement says so.
11. Property, damage and insurance
- We protect floors, furniture, landscaping and finishes near the work area and leave the site broom-clean at the end of each day where practical. Please move fragile or valuable items out of the work area before we arrive.
- We are responsible for damage caused by our negligence or our equipment and will repair it or compensate you for it. We are not responsible for pre-existing damage, hidden conditions, or damage to items we were not told about.
- We maintain commercial general liability insurance and Workplace Safety and Insurance Board (WSIB) coverage for our crews. Certificates are available on request.
12. Photos and communications
- We take photos of the work area before, during and after each job and visit. They are part of your service record and are used to plan the work, confirm what was done and resolve any questions.
- We may use photos of completed work in our portfolio, website or social media only with your permission, and never with your address, name or identifying details unless you agree.
- Service messages (on-the-way notices, visit reports, quotes, invoices, sign-in codes) are sent by the channels you chose. Marketing messages are sent only with your express consent under Canada's Anti-Spam Legislation, and you can unsubscribe at any time. See our Privacy Policy for details.
13. Limitation of liability
To the extent permitted by law, our total liability for any claim relating to the services is limited to the amount you paid us for the work giving rise to the claim, and we are not liable for indirect or consequential losses such as lost income or the cost of alternative accommodation. This limit does not apply to death or personal injury caused by our negligence, to our fraud, or to any liability that cannot be limited under Ontario or Canadian law, including your rights under the Consumer Protection Act.
14. Disputes and governing law
If something goes wrong, tell us first; most issues are resolved with a conversation and a return visit. If we cannot agree, either of us may take the matter to the courts of Ontario, including Small Claims Court for claims within its limit. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
15. Changes to these terms
We may update these terms from time to time; the effective date above shows the latest revision. Changes apply to new agreements and to recurring plans from the next renewal or billing period after we notify you. The written agreement for a job in progress is not changed without your consent.
